1. Agreement to Terms

By accessing or using the TransferCampaign platform ("Service") operated by Growth Campaigns LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our Service.

These Terms apply to all visitors, users, and clients of the Service. "Client" refers to any licensed insurance agent or agency that purchases live transfer services from Growth Campaigns LLC.

2. Description of Services

Growth Campaigns LLC provides live transfer lead generation services for licensed life insurance agents. Our services include:

• Outbound prospecting calls to identify consumers interested in life insurance products.
• Real-time transfer of qualified, consenting consumers to licensed insurance agents.
• Three buffer time options: 90-second, 120-second, and 180-second pre-transfer preparation windows.
• Access to the TransferCampaign qualification quiz and lead management platform.

3. Eligibility and Licensing

To use our live transfer services, you must:

• Be at least 18 years of age.
• Hold a valid, active life insurance license in all states where you conduct business.
• Comply with all applicable federal, state, and local laws and regulations governing insurance sales.
• Not be subject to any regulatory action, suspension, or revocation of your insurance license.

By using our services, you represent and warrant that you meet all eligibility requirements. We reserve the right to terminate your access if we determine you do not meet these requirements.

4. Payment Terms

Pricing for live transfer calls is as follows:

Volume discounts and custom pricing are available. Contact us via Instagram DM at @realajmartinez_ for custom rates.

All payments are due in advance of service delivery. We reserve the right to modify pricing with reasonable notice to existing clients.

5. Refund Policy

Due to the real-time nature of live transfer services, all sales are generally final. However, we will issue credits or replacements in the following circumstances:

• The transferred call lasted less than the agreed buffer time due to a technical error on our end.
• The consumer was clearly not interested in life insurance and the transfer was made in error.
• A duplicate transfer of the same consumer occurs within a 30-day window.

Refund or credit requests must be submitted within 24 hours of the call via Instagram DM. We do not issue refunds for calls where the agent was unavailable, did not answer, or failed to close.

6. TCPA Compliance and Client Responsibilities

Growth Campaigns LLC ensures that all consumers transferred to our clients have provided express consent to be contacted by a licensed insurance agent. All calls are 100% TCPA compliant on our end.

As a client, you are solely responsible for:

• Conducting all sales activities in compliance with the TCPA, state insurance regulations, and all applicable laws.
• Maintaining your own Do-Not-Call (DNC) list and honoring consumer opt-out requests.
• Obtaining any additional consents required by your state's insurance regulations.
• Any regulatory violations, fines, or legal actions arising from your use of our transferred calls.

Growth Campaigns LLC is not liable for any regulatory violations committed by clients after a call is transferred.

7. Referral Program

Growth Campaigns LLC offers a referral program with the following commission structure:

• Week 1 Bonus: 10% of the referred client's first-week spend.
• Ongoing Commission: $2.00 per call purchased by the referred client, paid for the lifetime of the referred client's account.

Referral commissions are paid at our discretion and may be modified or discontinued with 30 days' notice. Commissions are forfeited if the referring party violates these Terms or engages in fraudulent referral activity.

8. Prohibited Conduct

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable regulations.
• Resell, sublicense, or transfer access to our services to third parties without written consent.
• Misrepresent your identity, licensing status, or the nature of your business.
• Engage in any conduct that harasses, intimidates, or deceives the consumers we transfer to you.
• Attempt to circumvent our systems or access our platform through unauthorized means.

9. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee any specific close rate, revenue, or business outcome from the use of our live transfer services. Close rate figures cited on our platform are historical averages and are not guarantees of future performance.

10. Limitation of Liability

To the maximum extent permitted by law, Growth Campaigns LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to lost profits, lost revenue, or loss of business opportunity. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 30 days preceding the claim.

11. Termination

Either party may terminate the service relationship at any time with written notice (including via Instagram DM). We reserve the right to immediately suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or fail to make required payments. Upon termination, any unused prepaid balance will be refunded within 30 days, minus any applicable processing fees.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Growth Campaigns LLC is registered, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify existing clients of material changes via Instagram DM or email. Your continued use of our services after such notification constitutes acceptance of the updated Terms.
